Legal Question in Family Law in Montana
I was divorced in July 2010( we had filed the papers ourselves).My ex agreed to pay me 75% equity of our home when it was sold. The judge had told me we didn't put a date that neede to take place by and had told me if he didn't pay me when I felt I needed it then I would have to file papers. I'm not sure what papers those would be. Also do I need an attorney to do that on my behalf or can I do that myself? Also I'm responsible for paying the student loans for our daughter but I told him if he didn't pay me by a certain date then I would stop paying those. If he doesn't meet my obligations then I'm not going to continue to meet mine. One other question, if I am forced to file those papers to get my money can I also then make some changes like getting part of his retirement since I didn't ask for that at the beginning, only 75% of equity of home?

Do you need an attorney? Last time, you did it yourself and missed some important issues. Now you need to repair the mistakes. Only you can assess how much you've learned about identifying relevant issues and drafting the necessary legal documents. Your answer will tell you whether this is a do-it-yourself project.
