Father seeking custody while mother is incarcerated
We were divorced from California. I live in Montana. She moved the children back to California about 2 1/2 to 3 years ago, and i haven't seen them since. My 14 year old daughter came to live with her grandmother back in montana and finally found me. I went to see her, and found out that their mother is in jail in california for three felonies, and had been using drugs and living on the streets while they were transferred back and forth between a older brother and sister. I found my son finally in california. I now have both of them residing with me in montana. I have never had the money for an attorney to fight her for custody. She has lied to the children about me relinquishing my rights and told them that i didnt care about them. When i went to get my son, she had been telling him that if he lived with me, she would have a nervous breakdown and kill herself. My son is finally feeling safe. I NEED to get my children away from her. If she gets out of jail and finds the children again, I am afraid that i will never see them again. What do i need to do? Do you have any suggestions?

All US lawyers must do a "pro bono" hours during the year to mantain valid their license to practice.
Contact them and explain your case and ask for a pro bono legal assistance. You will be able to solve your case, have your children (if you qualify) and don't have to spend a fortune in lawyers professional fees.
If no one is available for pro bono assistance (which is unlikely in view of the time of the year we are) you might want to visit your local family court and ask for pro bono assistance there.
