Legal Question in Family Law in Montana
Filing for Divorce
My husband and I have been separated for approximately two months and are ready to proceed with the divorce. All material issues have been settled including real property ownership and child custody arrangements. I would like to file for the divorce without retaining legal counsel but don't know where to begin. Is there a standard format available that I can complete to file the petition with District Court?

Re: Filing for Divorce
Because you have a child and real property, you would be wise to at least arrange for a consultation with an attorney. It's usually easier and less expensive to do it right the first time. You should also read the Uniform Marriage and Divorce Act (Title 40), which is probably available at your county library. You can get a Summary Dissolution packet from the Clerk of the District Court, which will give you an idea of the information you need to include in the petition and decree. (The Clerk will not give you legal advice.)
