Legal Question in Family Law in Montana

Order to show cause?

How do husband and I deal with his ex that is CONTINUALLY breaking the court ordered visitation? We can not afford to get an attorney every time she does it. Can we issue an ''Order to Show Cause''? How do we go about it?

The parts of the court order that she is breaking is not just trivial things. It is not showing up for scheduled drop offs (we live 9 hours away from them), moving and not giving us addresses and new phone numbers, and not allowing ANY phone contact, up to 2 months at a time.

Thank you...

Re: Order to show cause?

you can file an order to show cause or you can just file a motion in re comtempt to hold her in contempt of court for violating the court order. in addition, make sure to ask for a change of custody as one of the requested sanctions for her voluntary refusal to follow the court order
