Legal Question in Family Law in Montana

I recently got a divorce in Nevada and granted full custody of my two children along with child support. I then moved to Montana and haven't received any child support from my ex husband, since the move. He still resides in Nevada and the child support arrangement was that he would give me cash in hand or mail it to me. Since I moved I have received nothing. My question is what do I do now? Should I obtain an attorney up here in Montana to enforce the child support order against my ex husband or can I personally go to the court in Montana to fill out paperwork and enforce it myself?

Thanks, Kelly Horigan

You can file in your local Montana district court a motion to domesticate the 'foreign decree' -- the Nevada child support order -- and seek collection through Montana's Child Support Enforcement Division. Montana CSED will not actually take over the case. That will result in automatic income withholding from father's paychecks, including enough extra to repay the support he refused to pay.
