Legal Question in Family Law in Montana
My Sister is in the hospital on life Support, she is a Kidney transplant patient, I am the only closest of kin that lives in the same town. she wound up there from not making it to her Dr. apts. and I want to know what steps I need to do to take legal Guardianship of her at this point. She also has a daughter who lives on the other side of the state and is 18, but does not want to make any decision for her mother.Kellie's Daughter just had a Baby and is still in High school trying to graduate. my Sister is not able to make decision for herself at this time. and a Doctor has hand written a letter on her behalf saying she is incapacitated at this time to speak for herself and she may even die. she is not Married but has a live in Boyfriend. and I have removed him from making any decisions for Kellie at this time. she has no car to get to her apts nor does he. What can I do? she is on full disability and she cant nor can I afford legal fees. what do I do for her? to get her help if she survives this?

Call Montana Legal Services Association and explain your situation, that your sister needs a health care directive and instructions to the doctors and facilities that she wants you to make decisions regarding her health care. If they can't do this for you, ask them to refer you to the Western Montana Bar Association Pro Bono Program. The PBP has a list of local attorneys who are willing to take low-fee or pro bono cases for qualified applicants (qualified through MLSA).
