Legal Question in Family Law in Montana

Support of a Non-Supporter

I pay child support to the Friend of the Court (MI) for my child that resides in Montana. The child is no longer living with her mother, she is currently living with grandparents. The childs mother continues to collect my support, without providing money for the child. I have contacted Montana and requested them to investigate the situation, but I have not had a response. The childs mother collects welfare benefits from Montana.

Is there anything else I should do? What are my rights?

Re: Support of a Non-Supporter

Dear Sir/Madam:

This is in response to your email of January 30, 2001.

I am not licensed to practice law in the State of Montana, so I am unable to answer your questions in this regard.

However, in Michigan anytime a party wishes to change or challenge child support payments, you must petition the Friend of the Court.

I hope this answers your question.

Very truly yours,

Blair Moody
