Legal Question in Civil Litigation in Montana

Compensation for Stolen Property

I recently moved and the company moving me ''lost'' my box containing three shotguns that my father had heiloomed to me after he died. now i'm tied up in a battle of wills so to speak about their value. i believe i'm well within my rights to be compensated for sentimental value for an item i can't replace. The moving company claims that it cannot pay sentimatal value and replacement value is all i get. Please help me understand what i can do. I feel i'm at a loss not only have i lost my fathers only real heirlooms that was given to me, and the moving company is basicly saying that any other gun of its make and model are a suitable compestation. I'm already on the losing side how can i see that they take MY value of the guns seriously. Thank you for your time and efforts.

You are probably out of luck; things like that have to be moved by you to keep them safe. If it was an intrastate move, contact your state highway department agency, motor carrier division. Interstate moves are regulated by the US Dept. of Transportation. They can tell you how reputable this company is and you can file a complaint and possibly force mediation. We could probably get you a free referral in MT if you need it; we need to add a MT attorney/firm to our group.

Take a look at your contract with the mover. It most likely limits their liability to the actual value of any property they lose or damage.

The contract probably also says that if you want more protection than this you should get insurance. Even if it doesn't say this, you could have insured the guns but chose not to. You cannot require the mover to give you the benefits of an insurance policy you didn't buy.
