Legal Question in Civil Litigation in Montana
Theft of sales leads
An individual who worked as a full-commission salesman for my company recently left my company and took with him my office computers, printers and all sales leads files. The sales leads were purchased by my company from an internet site and were not generated by the salesman. Three guaranteed sales were sabotaged by this individual, with a loss of income well over $100,000.00. The theft was reported to the local law authorities and I did recover my computers, sans all pertinent sales data, I have not recovered the printer to date. Additionally, I had paid over $5,000.00 in commission advances to this person. I would like to seek some sort of redress for my losses, which are substantial. How do I proceed?

Re: Theft of sales leads
The cause of action that you can file is a civil form of theft, which is called conversion. Basically, what he took from you was your property that the company purchased. Secondly, he intentionally interfered with your business relationship by stealing customers. Check his employment contract to see if these things are specifically addressed.

Consult a plaintiff's lawyer in your town about a civil suit to recover your company's damages. References may be gotten from your local bar association, and initial consultations/case evaluations are usually at no cost. Ask first.
