Legal Question in Intellectual Property in Montana

Internet Copyright Question

I am currently writing a book which is a compilation of the entire touring history of the rock band Guns N� Roses, and summaries of all available audio and video recordings for Guns N� Roses concerts.

I wish to use information concerning set lists from the website gnrontour.com, which contains the following message:

�� Copyright 1993-2005 John M. No part of this site may be reproduced without the expressed written consent of the author. All pictures on this site are property of those who scanned them.

You may not copy, reproduce, distribute, publish, display, perform, modify, create derivative works, transmit, or in any way exploit any content on GNRontour.com, nor may you distribute any part of this content over any network, including a local area network, sell or offer it for sale, or use such content to construct any kind of database.�

I do not wish to exactly copy the exact form of the set lists or use any of the media on his site, I merely wish to use the information from the site for my book, could I possibly face legal action from the sites owner if I did so without his permission? Is there anything I could do to avoid this? Communicating with him is out of the question due to personal problems between us.

Facts are not copyrightable subject matter; only the manner in which facts are presented is protectable. Thus, as often is the case, the warning notice goes too far.
