Legal Question in Legal Ethics in Montana

lawyer malpractice

I am a 48 year old woman who was divorced about 3 years ago. My attorney charged me $6000.00 for my divorce. My ex husband got the family home and I got all the bills (real role reversal) I paid my child support up front and have still been completely devistated.

My attorney had the nerve to tell me after we left the courtroom that "It looks like you got screwed!" My response was that he could still sleep at night.I had a balance of $2000.00 owing him but with the situation I could not pay. He has since turned me over to collections, our two boys now live with me(we have joint custody) and my exhusband still has not held up his end of the divorce nor does he like working anymore now that he did then. I am struggling finacially and can barely feed two teenage boys.

My question is do I have any recourse against my attorney and if so where would I start.

Re: lawyer malpractice

It is impossible to discuss this intelligently without having more facts. Why did you agree to joint custody? Why did you agree to give him the house? Was this a settlement or a trial?

As to current child support issues, suggest you consult with an experienced matrimonial attorney. While you are there, you may wish obtain a second opinion on the way your former attorney handled the case. Unfortunately, the statute of limitations for malpractice in your state may have expired.

Hope this helps.
