Legal Question in Banking Law in Nebraska
Bank Returning a Check
I deposited a check drawn on Wells Fargo December 11, 2006. Today, April 3, 2007 my bank notifies that it has been returned to them as account closed. This seems to be way out of the time alloted to return this item. The check is in the amount of 2500.00. Who is liable for this amount not that 4 months have passed? Do I have legal recourse?

Re: Bank Returning a Check
The person that issued the check to you is liable for the amount. Was it stopped, or account was closed by bank? You may have to sue, but a Demand Letter from an attorney may be a more cost effective first step.
