Legal Question in Banking Law in Nebraska
check writing lawsuit
my father wrote checks over several years to buy hay for our farm from a person who had boughten the hay with a loan. My father wrote checks to this person using his name on the pay to the order of line. This man deposited the money in the bank except that a bank employee was stealing this money, and not applying it to pay down the loan. Now the bank is suing my father because they say he should have also written the banks name on the pay to the order of loan because the hay was mortgaged. Is this right? what should we do?

Have a local attorney countersue under the UCC Article 7 & 9 for bad faith and negligence.
