Legal Question in Bankruptcy in Nebraska
Chapter 13 to 7
I filed chpt 13 in 10/07. I am having trouble making ends meet with payment to trustee. Can this be changed to chapter 7?

Re: Chapter 13 to 7
Please tell me you didn't file without the assistance of an attorney. If you are represented, you should immediately notify your attorney that you are struggling with your plan payments; there maybe something which can be done to adjust or temporarily suspend your payments depending on your circumstances.
If you are unrepresented, you should consult with at least two attorneys about representing you in a chapter 7 (if you are eligible.) This would require a motion to convert your case, and updating many of your initial pleadings, and should not be done without legal assistance.
But, if you are otherwise eligible for a Chapter 7, your case can be converted. I would have to have a lot more information about your case to tell you if that's a good idea (you may have debt which won't discharge in a 7, or property you can't protect.)
