Legal Question in Bankruptcy in Nebraska

My Mom owes a Student loan

My mom left everything to go and take care of my Grandmother who had cancer. My Grandmother has passed away my mom lost everything taking care of my Grandmother my mom is 55 yrs. old and will never be able to repay the student loan she is working part time at a fast food place. I have my own debts to take care of so I cant help. My mom is leaving with my brother right now but he isnt doing good right now either what can my mom do so she doesnt have to spend the rest of her life worring about this student loan. Thank you

Your mom would have to file a chapter 13 case and slowly repay her student loan over 5 years. There is a very small chance she could petition the bankruptcy court and try to show that she is never going to be able to pay back this debt. HOWEVER THIS IS VERY DIFFICULT TO WIN. The bankruptcy laws have been changed over several years and now it is very difficult to wipe out a student loan in bankruptcy. If your mom lives in Nebraska I can help her.
