Example Contracts

I am a defensive linebacker for the Kansas City Chiefs professional football team, and I am traded to the Cincinnati Bengals football team. The trade involves the assignment of my contact. I argue that the assignment is invalid because playing for Cincinnati just isn't the same as playing for Kansas City. Do I have grounds to argue this. If so, what am I arguing? What is my theory for thwarting the trade? Willthis theory and argument work?

It is a valid argument and there are limitations imposed on personal service contracts for the very reason you state. It would be the same as if you hired Gerry Spence to defend you in a murder trial and I showed up because he assigned the contract to me. This is a highly litigated area. Shirley MacLaine was involved in a similar lawsuit; you can Google for more information. You may be precluded from raising this argument by the terms of your contract. Usually, contracts involving payments with as many zeroes behind the figure as most professional sports contracts involve, will be very clear on the issue of assigning the contract. Perhaps you need a new sports agent or just need to become a valuable enough player to demand unique terms in your future contracts.
