You can file a small claims action against anyone, but that doesn't mean you will be successful. Even if you get a judgment by default (because they don't show up), how are you going to collect on it? If it doesn't involve enough money to justify hiring an attorney, you are probably going to get better results by pestering their customer service people for the solution you want. Some things are worth fighting for, other times it is best to learn a lesson and move on. Fighting in court has a high cost associated with it and it is necessary to prevent people from bringing every petty gripe and disagreement into court for the judge to solve. Whenever possible, you should solve problems through negotiation and compromise.
