Legal Question in Business Law in Nebraska

LLC member stoled money.

My wife and I have an LLC. I am the

managing member. Two months ago

my wife and I separated. While I was

away, she came into the office and

fired two of my employees and

withdrew 32,000 dollars from our

LLC bank account and has not been

back. Is there any legal

consequences for what she did. Our

Opereating agreement states if she is

going to resign she must give a 3

month notice in writing. And the

operating agreement says that

financial withdrawals have to be

agreed upon by all members. I don't

know where to turn to. Do I have to

take this up with a divorce attorney

and settle it than. Or can I sue he for

thee damages and loss in income, or

do I have the right to press criminal

charges against her.

You will need to hire a divorce attorney. In the meantime, close any joint accounts or credit cards and open new accounts in your name only. The attorney you hire can advise about recovering your loss and whether criminal charges should be filed.
