Omaha Nebraska City Ordinance
We have a smoking ban for offices in Omaha Nebraska. If this ban is violated, who is responsible? The employee or the employer?

You'll have to check the statute.
It would make sense for the employer to be held liable only if it had the obligation to stop individual acts which violate the law.
Usually, people are responsible for their own acts and employers are only liable when they had an obligation to stop it from happening and fail to do so.
