Downloading Music That You Already Own

If I purchased a physical cd a while ago, and it is all scratched up to the point that it does not play, is it still illegal to download the songs from the internet using Bit Torrent?

Yes, it would be illegal. You don't own any music, unless you wrote and performed it yourself. You have limited permission to use and enjoy music in relation to media you have purchased. If that media is damaged, lost, or destroyed; you need to pay to replace it.
