ADT Home Security Contract

We signed a contract with ADT, faxed in the cancellation notice within 3 days and were called by ADT the next day. We agreed to stay with ADT if they added a window break, which they agreed to do at no cost. Their installation person didn't show up then and 3 times thereafter. Now we want out of the agreement. Their customer service now says they can not find our cancellation notice. We sent the fax verification notice and cancellation notice. Now they say we are lying and have no records to give us the window break or any other documents. After 10 calls to them they finally said they will damage our credit and charge us $975. What are our legal rights?

If you rescinded (cancelled) the contract per its own terms, you have a valid defense in a breach of contract suit ADT may file against you. Be sure to read the contract carefully to see if it provides that ADT is entitled to some amount for the services it did render, or some non-refundable deposit, etc.

If any creditor reports to the credit bureaus a debt which you dispute, you should file a dispute form with the credit reporting agencies.
