Legal Question in Consumer Law in Nebraska

breaking a contract

I have a daughter that received a stem cell transplant to treat Leukemia. As a side effect she had intensive graft disease which lasted 2 whole months. In desperation I sought out an Alternative Medicine Doctor to help with her pain. After two sessions I signed a contract which I thought was authorization of services but it also stated that by purchasing a group of sessions I would get a discount. She told me she would not touch my daughter by massage but teach me the skills to help my daughter. At the thrid session I had to leave after 15 min becuase of rushing my daughter to the hospital for a possible fatal infection. I call the massage therapist and told her I did not think I was going to have the time to attend anymore sessions becuase of taking my daughter back and forth to the hospital 5 days sometimes 6 days a week. I asked for a refund for unused services and she had refused stating that by signing the contract I cannot have refund and must make the time to see her. I do not have the time. My daughters doctor visits consume all my time. I do not know what else to do and could use the money to pay for her medical bills. Please help.

Re: breaking a contract

I'd really need to see the document you signed to advise you on whether you are entitled to a refund or not. Practically speaking, you also need to consider how much money is at issue; if it costs you more to hire an attorney to go get it back to you, it might be something you want to try suing on in small claims court. I am sorry you are in such an awful position.
