Legal Question in Consumer Law in Nebraska

Machinery Lemon Law?

My husband bought a new windrower less than 30 days ago. Since then he has had to call for repairs on it 7 times (so far). Most of the repairs are dealing with the same area of the windrower, but not all. He is losing custom jobs because of the down time. The dealer has tried hard but he can't afford to keep a lemon like this. They don't want to take it back and get us a different one or even extend the warranty. What recourse do we have?

Re: Machinery Lemon Law?

The lemon law relates primarily to automobiles, but there are other protections available. You would need to hire an attorney to review the sales contract and a log of the dates/problems you have had with the machinery to determine the best course of action. Sometimes it helps to get the manufacturer involved instead of communicating only with the dealer. The sales contract may have an arbitration provision. In some cases, just having a lawyer involved improves the willingness of the dealer to resolve a problem to your satisfaction.
