Legal Question in Consumer Law in Nebraska
Post-Purchase Surprise
I bought a used car a little over year ago and since then, my circumstances have changed and am no longer in need of such a flashy car. I am still paying off the car and have made every payment on time. I recently tried selling it to a dealership and they found that there was frame damage to car, a very LARGE detail that the initial dealership failed to mention but was fully aware of. I can now no longer resell the car at the price it is worth; or at least enough to come out even. Is there a happy ending to this? Is there any way of going after the original dealership?

Re: Post-Purchase Surprise
How will you prove initial dealership knew of the defect? How do you know second dealership told you the truth and was not just trying to drive the price down? Apparently the defect is rather minor or it would not have taken you over a year to discover it; and only then because someone else told you about it. You have a slight chance of recovering from initial dealer if you can prove the questions I asked above. It may cost you more in attorney fees than the difference in price and you would have to pay the attorney in advance, win or lose.
