Legal Question in Consumer Law in Nebraska

Small Claims Judgement

Some collection company brought and old, out dated debt from US Bank along with thousand of others it seems and took them to court. This is a debt I have disputed many times and do not owe. I was not notified that I was to go to court over this ''debt' and the time of the court date I was doing jury duty. They got a judgement. I was not given a chance to protest it or anything. The summons to appear and answer was left at my home with minor children and I found it on the floor when I was cleaning up. When I went to court the judge just asked me to take the oath. They didnot ask for ID and I was sent to a room with a representative from the Collection company not the court to say where I live and if I have any money. I need to know if I can appeal or protest this judgement.

Re: Small Claims Judgement

You can try to appeal, but you will probably need an attorney to take it from this point. First, you need to convince the court that they should set aside the earlier judgment. Second, you will need to convince the court why you shouldn't have to pay the debt.
