Credit Cards

My mother died 4 years ago and had several credit cards in my fathers name without his knowledge. He is on Social Security and they can't touch it, but how long does it stay on his credit and is he responsible for it. I should also mention they were divorced for 10 years. He is 65 Years old and this has bothered him for so long as he had no idea that she even had these cards. She forged his name on the credit application then all of a sudden they came out of the wood work. Thank-You in advance for answering this question.

If your mother forged the credit application and your father never used the card, he could defend a credit card lawsuit by arguing that he's not liable for the fraudulently obtained debt. It will come down to the evidence in the case, like any other. This is a defensive approach.

To be proactive, your father should dispute the debts on his credit reports, and contact each creditor to report the fraud. The credit card companies should have a procedure to follow when someone alleges fraudulent card use. It may not be easy, but is worthwhile and may clear his credit and prevent execution against any other non-exempt assets your father may have.
