Legal Question in Criminal Law in Nebraska
If you are issued a citation for a misdemeanor, do you have to sign the ticket? What happens if you dont sign the ticket? The reason I ask, I was issued a citation for a misdemeanor. The arresting officer spelled my name wrong and marked me as the wrong gender. So if I didnt sign the ticket would I have gotten off the hook?
1 Answer from Attorneys
Of course not. That would give suspects the power to derail their own prosecutions. A system which worked that way would not be just.
The errors you describe are not even significant, let alone dispositive. A citation only has to give you notice of what you're accused of doing wrong. The spelling and gender errors didn't deprive you of such notice. Since you know what the correct information is, you haven't been misled by the mistakes either. The kind of technicality you're looking for doesn't exist.
