If this is your first one, it's a class II misdemeanor. If you had a prior one within the last 2 years, it's a class I misdemeanor.
Class II - minimum - no penalty; maximum - 6 months in jail, $500 fine, or both
Class I - minimum - no penalty; maximum - 1 year in jail, $1,000 fine, or both
