Legal Question in Criminal Law in Nebraska
Speedy Post-Conviction Relief
My son was granted a post conviction relief based on ineffective counsel in April 2006. He was also granted a court appointed attorney. The attorney did nothing for the remainer of 2006, or 2007. Late 2008 he took some depositions. He stated it was presented to the judge, but still nothing is happening. This has taken 3 years. Do we have any recourse?

Contact the clerk of the court, tell them what's happened since the court appointment, and ask for an explanation. There may be one, or the court may find its appointed attorney hasn't been up to the job, and appoint another.
Good luck. The wheels of justice do grind slowly, and take the defendant and his family into the mash.
