Legal Question in Family Law in Nebraska

Custody at Death of Unwed Parent

I'm in the process of creating a trust and writing a will for my young daughter. If I should die, will the other parent (we aren't married) have superior rights to custody despite the fact that there is no custody agreement? He doesn't live here and sees her every now and then. I've already chosen guardians and specified them in my will.

Re: Custody at Death of Unwed Parent

As long as parental rights have not been formally terminated, biological parents will have superior rights to custody than others you might have chosen as guardians.
