Legal Question in Family Law in Nebraska

Divorce

My Father moved from the state leaving his wife, who refused to go with him. He is the breadwinner and has medical issues which is the reason for the change of enviroment. Is there some law that says she is entitled to nothing in their divorce?

Re: Divorce

Did he leave from Nebraska or Arizona? I am not sure of the law in Nebraska, however, Arizona is a community property state which means everything acquired during marriage is presumed to be that of community property. Basically that the parties each own property acquired during marriage equally. Hope this helps!

Re: Divorce

There is no "law." Nebraska is an equitable division state. That means that, all things being equal, they divide the property. If you mean alimony, it is very fact dependent. Did they already get the divorce, or is he just telling her that she will get nothing? If the latter, she needs to get an attorney and get a motion for temporary support on file NOW. If the former, well, she may have an opportunity to have the decree vacated depending on the circumstances. Can you give more specifics?
