There is no legal advantage to filing first. But there are certainly psycological issues relating to who initiates the action. These "feelings" can play an important role in the divorce settlement negotiations. I impore those seeking a divorce to not think in terms of gaining an "advantage" over their spouse. Divorce is a problem to be solved, not a war to be won.
