Legal Question in Family Law in Nebraska
graduating, getting marrried and moving out of state
I am getting married in April, graduating with my RN degree in May. I have one child, 8 years old. I am required to ask permission from the courts to move out of state and show that it is in the best interest of my child. I am in the process of requesting permission, sending notification to child's Dad as well as a suggestion in revised visitations.
We are relocating to Indiana where my fiance lives, owns a home and works for a well established company. I have been accepted into a Masters program to gain my Nurse Practitioner degree through UofI and have a job lined up with a physicians clinic working part time so that I can spend the next two years getting my Masters.
What else do I need to show that this move is in the best interest of my child? Could my child be taken away from me if Dad fights for custody and if so under what terms? He has NO family here, works out of town, is only available for her and to help out on his weekends. I will be moving away from my Mom and Dad and one of seven siblings. I'm 35, fiance is 38 and child's Dad is 38.
I don't want to lose custody of my child! What suggestions do you have for me? Is is the Dawes County court strict with move-away?

Re: graduating, getting marrried and moving out of state
Paul Empson is the District Court Judge in Dawes County. I practice before that court and would advise having all of your i's dotted and t's crossed prior to filing a motion to remove the child(ren) from the jurisdiction.
I'd be happy to discuss the specifics with you. I can be reached at 308-762-3000.
