noncustodual parent claiming chikd on taxes

I live in nebraska, My decree says the noncustodial parent gets to claim my child every other year. The decree does not say ''only of he is current with child support'' but someone told me he cannot claim her if he was behind on December 31 of the yr he will claim her for. Is this true?

If it is not in the decree, he can still claim her. It would definitely be worth it for you to file a motion to modify the decree to change that. You may even be able to get it in before he files if you are quick.
