Legal Question in Family Law in Nebraska
I would like to have sole custody of my daughter, and I am located in Nebraska. My daughter's father has not been an active participant in her life, and has dodged being served for child support. He has other children(aprox4) that the child support system has garnished from his wages for when he does work, and he has no interaction with any of these children. He is not able to hold a job and has nowhere to live at this time. Her father has had minor infractions with the law such as drug possession. What is the likeliness a judge will grant me sole custody in Nebraska? What are the steps that I should take to move toward gaining sole custody? Is there a way that I can gain custody with out going to court?

Get an attorney. It has been my experience that although your child has been with you, if her father takes her, the police in Nebraska will not force him to give her back to you unless there is a court order.
