Legal Question in Civil Litigation in Nebraska

30 Year Old Sexual Assaults/Druggings By Police Officers

What are the chances of seeking damages against the City of Omaha, NE for a series of sexual assaults at the hands of two off duty police officers which occurred nearly thirty years ago in Omaha, NE? The assaults were some kind of standard procedure by these two police officers and another man who later turned out to be a prominent US Congressman. The same MO occurred in each assault in which children were drugged with heroin, then they or their mothers were sexually assaulted while their fathers were away. There are at least two victims willing to come forward including the sexual assault victim of the Omaha police officers. The cover up by the OPD into these assaults was/is extensive.

What is needed for evidence? Have two now adult child victims willing to come forward and can subpeona the mother of one of the children whose home one assault and drugging occurred. It is believed these two men are still employed as police officers in Omaha, NE although they may have retired by now. Also, the former US Congressman attacked several married mothers and forceably sexually assualted them during the same time period after giving these women's children heroin and in one case beating the child up after he tried to stop the rape.

Re: 30 Year Old Sexual Assaults/Druggings By Police Officers

These claims are likely barred by the statute of limitations. Claims by the mothers on their own behalf and on behalf of their children would be barred as occurring too far in the past and the courts would refuse to hear them since the mothers have "sat on their rights" for too long a period of time. It is likely that the claims by the children are similarly barred by the statute of limitations, but this would depend on how much time has passed since their 21st birthday and the ability to bring the actions on their own.

Additionally, any suit that attempts to cover issues from so long ago faces difficulty in proving the case. People's memory fades, evidence is lost or destroyed, and witnesses move or die. It is very difficult to win such a case, though not impossible.
