Re: green card after divroce

If you have entered your marriage in good faith, but had to divorce before your conditional green expires (I'm assuming you have a conditional green card), you can still request USCIS for a waiver of the joint filing requirement when applying to remove the conditions on your permanent residence. You need, however, to make sure that your divorce is finalized before the expiration of your conditional residence and that you have enough evidence to proof the good faith of the marriage during the time it lasted. If you have any further questions or need any assistance with this matter, please feel free to contact me.

Re: green card after divroce

If we can establish that the marriage was entered into in good faith (meaning that everything was legit and it was not done for any type of immigration benefit) we may still be able to maintain your green card and make it permanent. Also, if there was any type of abuse in the relationship by your spouse we might be able to use that as well but may need documentation of such. You can call our office and we can provide you more detailed guidance after getting some more details from you.
