Legal Question in Immigration Law in Nebraska

My husband is being granted an immigration bond. He is consenting to voluntary departure. My question is, if I put the application in for his green card before his voluntary departure date, can he stay here? Is it even allowed for me to apply for a spousal green card once he has agreed to voluntary departure?

If you are a US citizen and are in a position to show adequate financial resources, as per requirement fixed by US Govt for your area, you may apply for his LPR.
