Legal Question in Insurance Law in Nebraska

Health Insurance

I was working for an employer that provided me with health insurance. A new company got the contract at the business where I work and I was retained by the new company. I was never advised that my insurance was cancelled and wasn't given the chance to keep cobra and in the mean time I had to have surgery and the insurance refused payment as they say I wasn't covered. I believe that I should have been covered with the insurance either the orginal policy or the cobra coverage. My question is that when I discovered this I asked for cobra Insurance and shouldn't I still be covered or is it legal for them to deny coverage?

Re: Health Insurance

I suggest you contact lawyers who practice in the following areas: 1) insurance law; 2) employment law; and 3) disability law. I represent people who have suffered serious injuries in car accidents; therefore, I cannot take your case. The requirements for continuation of health insurance are, I believe, federally mandated; therefore, your employer may have violated federal law in this instance. An insurance lawyer who regularly represents people who have conflicts with their health insurers could provide you with valuable information about your case. Employment lawyers and disability lawyers also have experience in these questions. You can find these lawyers on the internet or by contacting the Nebraska State Bar: http://www.nebar.com/

I hope that I have helped you.

I hope that I have helped, answered all of your questions, and that I have provided you with useful information. Please contact me if I have not answered all of your questions.

Please be aware that my answer is not legal advice, it is merely information. You and I have not entered into an attorney/client relationship. The only way that I am legally responsible for your legal rights is if you have signed a written retainer agreement with my law firm.
