Legal Question in Insurance Law in Nebraska

the same insurance company provides to both parties in a auto accident.

if the both parties in a car wreck are covered by the ssame company, and the other party in the accident is found liable for injuries and damage.

without suing can the other party claim the following and be paid by the company.

1. lost wages

2. 100% rental car costs

3. pain and suffering

and how does one ask the company for these without the assistance of a lawyer or should a lawyer be involved?

Yes, the company is responsible to the victim the same as if it only insured the negligent defendant. Put everything in writing, and if the same adjuster is handling the claims of both parties, you will need a lawyer, which is probably the smartest thing to do from the start. The insurer has a conflict of interest and will use the information you give, as an insured, against you as a claimant.
