Legal Question in Employment Law in Nebraska
Employment Issues
In November 2006 I was diagnosed with a type of Cancer that caused me to have sergery that put on Family Medical Leave until mid January 2006. Since returning to work I have suffered mental distress from my manager. Being told, ''you are not to discuss any of your illness with co-workers as they do not need to hear about how you do not feel good,'' even if asked. I am to respond, ''you feel fine!'' Projects are not communicated to me correctly and I am constantly being put down for my job performance. I feel that I am being punished for taking the time off that I did and the fact that physically and mentally I'm not well. Specific details are available if needed, but today was the day that I couln't take any more. I have worked for this organization for 7 years and never in all my time of employment have I ever been treated like a dog until today. My manager told me verbally to put in a request, when I did an email was sent by my manger to all parties stating that I should not of put in the request. Feeling humiliated, I went to her to stress my consern only to be yelled and and abruptly be told to exit her office immediatly. I want to know if I have any recourse agains this type of treatment?

Re: Employment Issues
The Family and Medical Leave act prohibits employers from retaliating against you because you exercised your right to take medical leave from your job. Whether the conduct you've described violates the FMLA is difficult to tell based upon the information provided, but you should consult with an attorney immediately to learn what rights you may have.
