Legal Question in Employment Law in Nebraska

I just recently returned to work after a 6 week maternity leave with FMLA approval. I no longer have a desk to work at, all of my files, etc are in boxes that people have taken many of my work items. A temp is working at the desk is supposed to be mine and now I do work for her. Stuff that she cant finish. When I asked when I would have my desk back I was told by October 1 when the temp is done. But the thing that irritated me was that I was told that since I chose to have a baby and I chose to take a maternity leave, she (my boss) choses to use my desk at her discretion. I dont have access to certain computer programs like I used to and feel that my work in hindered. I am the lead billing specialist and cant answer questions because I no longer have access to a computer. Is this legaL? I was under the assumption with FMLA I was to be restored to my prior position without penalty. I feel that I am being penalized for starting a family. I have worked there for 3 years and have been a faithful and loyal employee.

Discrimination based on pregnancy is a direct violation of the Federal and State statutes, exclusive of the FMLA. You should contact an attorney to discuss your case.
