Legal Question in Employment Law in Nebraska

Mandatory Overtime

I wanted to know if your department supervisore states that you will have a mandatory overtime of 10 hours per week and that you will be terminated from your position or have written disciplinary action taken upon you if not done, is that legal? Also if you work over 40 hours in a week is anything over that considered overtime? I take a class at my job on Tuesday's from 5:30 pm to 7:30 pm on the clock and my supervisor states that I am not paid that as overtime and it will not count towards the mandatory 10 hours of overtime in our department, is that legal?

Re: Mandatory Overtime

Your employer can require you to work as many hours as they deem appropriate--and you do not have to agree, you could go to work elsewhere. However, if you do work more than 40 hours per week, in many instances the law does require that overtime, time and a half your regular rate of pay, be paid for all hours above 40 in a work week. Accordingly, if you believe you are not being paid at time and a half for all hours above 40, please feel free to contact us at (561) 447-8888.
