Legal Question in Landlord & Tenant Law in Nebraska

clarification of earlier question

I understand your response regarding the month to month clause, however my main concern is: can a property manager/landlord legally say one tenant is in violation of standards while ignoring the exact same offense from a large number of other tenants? It appears that this is a pattern of borderline harassment, and would like to know the legal rules....

Re: clarification of earlier question

That question is more difficult. If you had a lease; and the landlord was trying to have you removed for violating a condition of the lease; and landlord did not enforce that provision among other tenants; then you would be able to raise a waiver and estoppel argument,i.e.,the landlord waived his right to enforce that provision and is estopped from using it against you. Also a landlord is prohibited from discrimination on the basis of race, religion, or national origin; but other than those restrictions, landlords can be pretty unfair with very few limitations.
