landlord/tenant law - deposit

I am in Lincoln Nebraska and the landlord wants to keep a $150 fee they ''routinely'' deduct for carpet cleaning. He commented after the walkthrough that the residence was very clean, but they always deduct that fee. From what I read in the law they can only deduct for damages, or a cleaning fee if the residence is dirty. Not only this, but they have 14 days to return my deposit and it has been 20 days since the walkthrough and 24 days since we moved out. Can they keep the $150 and what can I do to get my deposit back?

You have already done some research and appear to be articulate and well-informed. You could print out a copy of the Nebraska Landlord Tenant Act(Nebraska Revised Statutes 76-1401 through 76-1449) and highlight the pertinent provisions and show them to your landlord. A better solution would be to contact a real estate attorney in Lincoln (I would recommend Ward Hoppe at Hoppe-Harner). The Landlord Tenant Act provides for attorney fees and penalties in certain cases so you shouldn't have any out of pocket costs. You might also contact the legal clinic at the UNL College of Law; they may not be accepting new cases at this moment, but this is precisely the type of work they do and there is no charge to you.
