Legal Question in Landlord & Tenant Law in Nebraska

tenants rights

i have signed a 6 month lease with my landlord. she has refused to fix the water heater (i have to re-light it all the time cause it goes out.), and she wont fix the heater (the pilot light goes out in that also all the time.). i have sent her a letter stating that she needs to fix these things. i have a daughter who is a year old and need heat and hot water. is this grounds to break my lease. i have 4 months left on it?

Re: tenants rights

Maybe, you will need to visit with an attorney to get a more definite answer. Generally, your landlord is required to provide heat and hot water. You say that the pilot lights go out. Your attorney will need to know: How often does this happen? How long is the heat or hot water interrupted? Does landlord relight the pilots when requested? Do they do it in a timely manner? Have you talked with a repairman that says a repair is necessary or is that your own conclusion? Depending on the answers to those questions, an attorney may be able to help you break the lease or get the situation resolved. Unless the premises are exempt from the Nebraska Landlord/Tenant Act; your attorney may be able to recover his fees from the landlord in addition to any other relief.
