Legal Question in Real Estate Law in Nebraska
Deed Improperly Notarized at Closing
During our closing, we were told by our closing agent that she would get the deed notarized. The Notary was not present and did not witness our signatures. So we just bought this house and now we aren't sure if the transaction was ''legal''. Is this a problem? What is my legal standing? Someone thought I might be able to somehow get the house ''free and clear'' because of a fraud notarization, but I know nothing about that.

Re: Deed Improperly Notarized at Closing
It is the seller's signature(s) on a deed that needs to be notarized. Whoever suggested you might get the house 'free and clear' is wrong. You should hire an attorney to examine the status of your title if you are concerned. There is no possible way to determine whether or not mistakes were made without examining the closing paperwork.
