How long do we have to wait?

My husband file in Aug of 01 his claim was denined so we had to wait for the appeals that was also denined in May of 02. We are still waiting for a hearing it is now in the 13th month of waiting. We have written to our congress and we have a attorney. So help what is left to do? My husband had a major back surgery, COPD and anxity. Then in Dec of 02 he had a heart attack. What more do they need??

You indicate that you have an attorney, and she/he would be best able to answer your question concerning the particular circumstances of your husband's case. However, sadly it is not terribly unusual for there to be a delay in having a hearing before an administrative law judge in social security cases. There is a large volume of cases that must be handled and delays often result. The backlog of cases in the Omaha area has gone down, but at one time 15-18 month delays were not uncommon.

My suggestion is to be certain to keep your attorney advised of further developments in your husband's health care, and have the records available well in advance of the hearing.
