Legal Question in Bankruptcy in Nevada
Chapt 7 and time period
We have filed a chapter 13 and it sounds like it will be denied. We have tried to keep up with our mortgage payments since filing chpt 13 but have been unable to for multiple reasons. If we switch to a chapter 7, what is the time period before they come foreclose on our house? We have found our lawyer to be useless in giving us any information and we plan to file the chapter 7 by ourselves.

It depends on if they already started the foreclosure. If they haven't started the process you will have about 120 days from the notice of breach. If they have already started and have published and everything you may only have a few days or weeks before the sale date. You need to find out the sale date if they have already started the foreclosure before you filed the ch 13. If you need more advice e-mail me.
