Legal Question in Bankruptcy in Nevada
Chapter 13 BK
I filed chapter 13 BK in 1995 and it was discharged in Jan 0f 1999.
One of the listed creditors has taken a charge off as of 12/2002 which will saty on my credit report untill sept of 2004. Can they do that?

I think what you are saying is that a creditor falsely reported to the credit bureau a debt listed in your bankruptcy." There is a procedure to dispute false credit reports and you should begin by following them. In a typical Chapter 13, most of the creditors are paid nothing and your debt to them is discharged. It would be a good idea to double check your bankruptcy paperwork to see if this creditor was actually listed. You might also check the Trustee's report showing who was paid in your bankruptcy. When you file the dispute with the credit bureau, you may wish to include the paperwork to prove that you are telling the truth. Good luck!
